Silver&Fit® is a fitness and healthy aging education program designed for older adults. It is made available through American Specialty Health Fitness (hereinafter referred to as Silver&Fit). Silver&Fit values its users and respects their privacy. We collect user information in an effort to improve the user experience and to communicate information about our products and services. Silver&Fit is committed to using user information responsibly. Silver&Fit will not sell or rent any online information provided by a user to third parties. If you access Silver&Fit through one of its health plan partners, any information collected is governed by this Silver&Fit Privacy Statement.
The following Privacy Statement discloses the privacy policy for Silver&Fit by describing:
- The personal information SilverandFit.com may collect;
- Why the personal information is collected;

What kind of information does SilverandFit.com collect upon Opt-in?
The information collected may be considered Protected Health Information (PHI) and Personally-Identifiable Information (PII). Silver&Fit collects only the minimum PHI and PII necessary in order to complete an online request.
What sections of SilverandFit.com collect PHI and PII?
Silver&Fit collects PHI or PII in the Site Registration/Enrollment, Health Trackers, Longevity Game and the Contact Us sections of the Silver&Fit Web site.
- Registering/Enrollment with the site requires name, date of birth, address, e-mail address, home phone number, and credit card information if you are required to pay a copayment prior to enrollment and do so using a credit card.
- Health Trackers require Silver&Fit to record various health information.
- The Longevity Game uses PHI or PII to estimate a user’s lifespan based on a series of questions. Any PHI or PII provided in this section is not linked or stored with the Web site and is only exchanged between the user and the user’s browser.
- The Contact Us page requires name, phone, e-mail address, inquiry type, and comment.
Why is PHI and PII collected?
PHI and PII is used solely to address user’s requests regarding the Site Registration/Enrollment, Health Trackers, Longevity Game and the Contact Us sections of the Silver&Fit site.
If you choose not to provide PHI and PII in the initial registration/enrollment process, you will not be able to access or use SilverandFit.com. Once registered/enrolled, you may enter PHI and PII, such as weight, body measurements, and health habits, into your account using Health Trackers. You are not required to enter PHI and PII into these areas. However, if you chose not to provide the information, you will be able to access these functions, but you will not be able to track your progress.
How does Silver&Fit use PHI and PII?
Silver&Fit collects PHI and PII (including, but not limited to name, e-mail address, mailing address, and/or telephone number) when the user commences communications with Silver&Fit.
PHI and PII is used for a number of reasons:
- When information is submitted while registering/enrolling with the Silver&Fit site the information can only be seen in a secure location in the My Programs section and a unique User ID is created to coincide with the registration/enrollment information. Registering for the Web site allows users to gain access to special features on the site.
- Information submitted in the Health Trackers and Silver&Fit Connected! is used to record various health related values over time.
- Information submitted in the Contact Us section is used to help resolve feedback.
- After removal from an e-mail or mail list Silver&Fit will maintain names in a "do not mail" file to ensure the request is honored.
- The Longevity Game uses information to estimate the user’s lifespan.
What information does Silver&Fit share with third parties?
As stated previously, Silver&Fit will not sell, trade, or rent any online information provided to third parties. A credit card processing company bills users for annual member fees. These companies do not retain, share, store or use any PII for any secondary purposes. In addition, Silver&Fit may provide reputable third party vendors with aggregate statistics regarding users, sales, Silver&Fit site traffic patterns and related site information. The information provided will not include PHI or PII, meaning there will be no personal information. In addition, Silver&Fit may release account information when Silver&Fit believes, in good faith, that such release is reasonably necessary to:
- Comply with law; or
- Enforce or apply the terms of any of our user agreements; or
- Protect the rights, property or safety of Silver&Fit, our users or others.
How can users Opt-Out of collection of PHI or PII?
To Opt-Out of providing PHI or PII while using SilverandFit.com, contact Silver&Fit directly using the e-mail address service@ashn.com or the contact information provided at the end of this Privacy Statement, rather than using the Contact Us form.
What are Silver&Fit’s Limitations on amendment, deletion, or removal of information?
Members maintain the right to amend PHI or PII if the member believes the PHI or PII is inaccurate or incorrect. A request for an amendment must be made in writing on the Member Request to Amend Protected Health Information form, available online or upon request through the contact information at the end of this Privacy Statement. Failure to fully complete all sections of the form may result in the form being returned to you. Response to the request for amendment will be issued within 30 days of receipt of the completed form. However, we may obtain one 30-day extension by sending the member a written notice stating the reason for the delay and the expected date of the response. We may deny the member’s amendment request under the following circumstances:
- The PHI or PII is accurate and complete.
- The request for amendment was made verbally.
- The request does not state a reason for the amendment
- We did not create the PHI or PII, unless the originator is not available to act on the request.
PHI and PII cannot be removed from the system and will be retained for a minimum of 7 years in accordance with the record retention policy. User accounts, however, may be disabled upon written request, using the contact information at the end of this Privacy Statement.
How can users remove information from e-mail, phone and U.S mailing lists?
Silver&Fit communicates with users only if requested. If the preference is to not receive information from Silver&Fit contact Silver&Fit directly through any means noted at the end of this Privacy Statement. Silver&Fit staff will need to contact the user for order confirmation. The user may be contacted via phone, e-mail or U.S. Mail for questions regarding his/her order.
Users can unsubscribe from the newsletter by logging into their Silver&Fit account and changing their option for receiving the newsletter. Instructions for unsubscribing are included with each edition of the newsletter.
Unsubscribe requests may take up to 30 days to process once received. After removal from an e-mail or mail list Silver&Fit will maintain names in a "do not mail" file to ensure the request is honored.
How does Silver&Fit protect the privacy of minors?
Silver&Fit is concerned about the safety of children when they use the Internet. If Silver&Fit becomes aware that a subscriber is under the age of 18 and has registered without prior parental consent, we will remove his or her PII from our files.

How does Silver&Fit ensure information is secure?
In order to maintain the confidentiality of PHI and PII Silver&Fit enforces strict company-wide policies regarding privacy, security, and confidentiality.
Silver&Fit has an organizational commitment to protecting privacy and security. All employees who work on SilverandFit.com are aware of security policies and practices through employee orientation and annual refresher training. PHI and PII is secured in an isolated database with tightly restricted access. Employees authorized to view this information are authenticated prior to gaining such access. Silver&Fit reviews web security on an ongoing basis. In addition to daily security administration and response activities, the Silver&Fit environment undergoes an overall security review on an annual basis.
Silver&Fit uses Secure Sockets Layer (SSL) technology to protect the security of on-line order information, including credit card information. Users will see an unbroken key or a closed lock (depending on the browser used) in the lower left-hand corner of the browser window when SSL is active and the server is secure. The URL line of the browser will also contain "https" instead of "http".
Some versions of browsers and some firewalls don't permit communication through secure servers. In that case, users will not have the ability to connect to the server and therefore won't have the ability to place an order through an unsecure connection. What is Silver&Fit’s policy regarding links to other Web sites and services?
Silver&Fit links to other sites to verify our participation in programs that protect privacy and security, and we send members a link to their Medicare Plan's website. No PII or PHI is shared with these sites. The appropriateness of links to external sites is reviewed semi annually.
